One IBC: Register Trademark In Hong Kong, Easy Or Hard?

Check trademark availability

Before registering a trademark in Hong Kong, One IBC will conduct a trademark availability check using Form T1 (Trade Mark Form T1) of the Intellectual Property Department (IPD) or do an online search. The checking process for a new registering trademark will see whether:

• The trademark is capable of distinguishing from other goods/services;
• The trademark is different from other goods/services;
• The trademark is a generic term;
• The registered trademark is the same or similar to another registered trademark.

Fill in trademark application form

Once done checking your trademark availability, One IBC’s expert team will assist you to file an application form (Form T2 or T2A), then submit it to Hong KongIntellectual Property Department.

Do trademark assessment

After submitting the application form, Hong KongIntellectual Property Department will verify whether the mark is eligible for registration of trademark protection in Hong Kong. The trademark assessment is conducted through an examination of factors such as: appearance, group, clarity, distinguishable from other trademarks, trademark description, conflict with an earlier application.

Information on trademark applications will be published in Hong Kong Intellectual Property Magazine. Any claims (if any) against your trademark registration with the Hong Kong Intellectual Property Department can be made within 6 months from the date of publication.

Complete trademark registration

After the assessment period, the trademark is officially accepted, a Certificate of Intellectual Property is granted for your registered trademark. This notice will be published in Hong Kong Intellectual Property Magazine, the effective date starts from the date of submitting your application. That means you have the exclusive rights and uses of your registered trademark from the effective date, your trademark will be protected under Hong Kong law for a period of 10 years.

The trademark registration in Hong Kong can be renewed for further periods of 10 years each, with the payment of renewal fees.
